Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the website and services ("Services") provided by Weronika Laszczka, with registered address at Narciarska 9A, 31-579 Kraków, Poland (the "Provider", "we", "us"). By using our Services you agree to these Terms. These Terms are drafted in accordance with Polish law and applicable European Union legislation, including Regulation (EU) 2016/679 (GDPR) and Directive 2011/83/EU on consumer rights.

1. Services

We design and develop cross-platform software (iOS, Android, Web, Windows, macOS). The exact scope, deliverables, timeline and price of each engagement are defined in a separate written agreement or statement of work signed by both parties.

2. Orders and contract formation

A contract is concluded once we confirm acceptance of your order in writing (including by email). Prices listed on our website are indicative starting prices in EUR and may be subject to VAT where applicable.

3. Payments

Unless agreed otherwise, an upfront deposit of 50% is required before work begins, and the remaining balance is due before final delivery. Late payments may incur statutory interest in accordance with Polish Act of 8 March 2013 on counteracting excessive delays in commercial transactions.

4. Right of withdrawal (consumers)

If you are a consumer within the meaning of EU law, you have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU. The right of withdrawal does not apply to contracts for the supply of digital content not on a tangible medium if performance has begun with your express prior consent and acknowledgment that you thereby lose your right of withdrawal. 5. Intellectual property

Upon full payment, you receive the rights to the final deliverables as agreed in the statement of work. We retain rights to pre-existing tools, frameworks, libraries and know-how used to deliver the project. We reserve the right to reference the project in our portfolio unless otherwise agreed in writing.

6. Warranties and liability

We provide Services with professional care. To the maximum extent permitted by law, our total liability arising out of or in connection with the Services is limited to the amounts paid by you to us for the Service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (including for wilful misconduct or gross negligence).

7. Personal data

We process personal data in accordance with our Privacy Policy and the GDPR.

8. Complaints and dispute resolution

Complaints should be submitted to hello@laszczka.digital. We will respond within 14 days. Consumers may also use the EU Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.

9. Governing law and jurisdiction

These Terms are governed by the law of the Republic of Poland. Mandatory consumer-protection provisions of the country of the consumer's habitual residence remain unaffected. Disputes shall be resolved by the courts competent for the seat of the Provider, unless mandatory law provides otherwise.

We may update these Terms from time to time. The current version is always available on this page.
